20px;\">Carte professionnelle : obligations<\/span><\/strong><\/p><p class=\"ItemInfo\">Tout \u00e9ducateur sportif r\u00e9mun\u00e9r\u00e9, qu\u2019il soit salari\u00e9 ou ind\u00e9pendant,\u00a0doit \u00eatre titulaire d\u2019une carte professionnelle\u00a0d\u00e9livr\u00e9e par le\u00a0SDJES (Service d\u00e9partemental de la jeunesse, l\u2019engagement et des sports) en formulant une demande (\u00e0 renouveler tous les 5 ans) sur la plateforme de d\u00e9claration des \u00e9ducateurs sportifs.<\/p><\/div><div class=\"itemBody\"><div class=\"itemIntroText\"><p>Cette carte atteste que l\u2019encadrant poss\u00e8de les qualifications requises (BPJEPS, TFP, BEES,\u00a0<em>etc.<\/em>) et qu\u2019il est autoris\u00e9 \u00e0 exercer en toute l\u00e9galit\u00e9 (v\u00e9rification du casier judiciaire).<\/p><p>Pour les \u00e9ducateurs en cours de formation professionnelle, cette d\u00e9claration est aussi obligatoire et permet d\u2019obtenir une attestation de stagiaire.<\/p><p>Obligations et recommandations aux dirigeants<\/p><ul><li><p>V\u00e9rifiez la carte professionnelle de chaque encadrant r\u00e9mun\u00e9r\u00e9 avant sa prise de fonction et de mani\u00e8re r\u00e9guli\u00e8re une fois salari\u00e9 sur la plateforme des \u00e9ducateurs sportifs :<\/p><p><a href=\"https:\/\/recherche-educateur.sports.gouv.fr\/\" target=\"_blank\" rel=\"noopener\">https:\/\/recherche-educateur.sports.gouv.fr\/<\/a><\/p><\/li><li><p>Afficher les copies des dipl\u00f4mes et cartes professionnelles de tous les \u00e9ducateurs salari\u00e9s dans un espace visible du public (Articles R322-4 du code du sport) et conserver une copie des justificatifs (dipl\u00f4mes, attestations d\u2019honorabilit\u00e9, carte professionnelle)<\/p><\/li><li><p>D\u00e9clarez tout nouvel encadrant (salari\u00e9 ou b\u00e9n\u00e9vole) sur Gest\u2019hand<\/p><\/li><li><p>Sensibilisez votre \u00e9quipe aux obligations l\u00e9gales pour \u00e9viter toute irr\u00e9gularit\u00e9<\/p><\/li><\/ul><p><span style=\"font-size: 20px;\"><strong>Cons\u00e9quences en cas de manquements<\/strong><\/span><\/p><p>Les services de l\u2019\u00c9tat effectuent des contr\u00f4les inopin\u00e9s dans les clubs<\/p><p><strong>Sanctions p\u00e9nales et administratives (Article L212-8)<\/strong><\/p><p>Est puni d\u2019un an d\u2019emprisonnement et de 15 000 euros d\u2019amendes le fait pour toute personne<\/p><ul><li><p>d\u2019exercer contre r\u00e9mun\u00e9ration les fonctions de professeur, \u00e9ducateur, entraineur d\u2019une activit\u00e9 physique ou sportive sans cartes professionnelles \u00e0 jour<\/p><\/li><li><p>d\u2019employer un \u00e9ducateur sans carte professionnelle<\/p><\/li><\/ul><p>En cas d\u2019infraction, l\u2019association peut \u00eatre sanctionn\u00e9e par une suspension des activit\u00e9s, une suppression de subventions (d\u00e9cret n\u00b0 2021-1947 du 31 d\u00e9cembre 2021), voire une fermeture administrative.<\/p><p>Responsabilit\u00e9 du club et mise en danger des adh\u00e9rents<\/p><ul><li><p>en cas d\u2019accident grave impliquant un \u00e9ducateur non d\u00e9clar\u00e9, la responsabilit\u00e9 de l\u2019association peut \u00eatre engag\u00e9e, notamment pour mise en danger d\u2019autrui.<\/p><\/li><li><p>les assurances peuvent refuser de couvrir les dommages si l\u2019\u00e9ducateur n\u2019est pas en
